Any broadcasts that you create or public profile information that you provide may be used by SellCast for advertisement or promotional purposes.
We may ask you for your name and email address to stay in contact with you. We receive and store Sensitive Data. You may elect to not provide Sensitive Data to us, although doing so may prevent you from engaging in certain activities.
The Site and Services may be accessed with at least limited functionality by means of a mobile device. You agree that you remain responsible for any data, text or phone service charges which may be incurred in the course of such access.
Information We Gather Automatically
When you use, log into, or remain logged into the Site and Services, files and other data are sent to, and stored on, our web servers. Our web servers automatically save and store this anonymous information. Examples of the information we collect automatically (without you providing it) and analyze include the Internet protocol (IP) address used to connect your device to the Internet; login; e-mail address; password; computer and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, and operating system; metadata and timestamps used to keep track of listings; usage information in order to suggest broadcasts and other content that may interest users; the full Uniform Resource Locator (URL) click path you followed to and from our website or mobile commerce application, including date and time. We use this data to learn more about your use of the Site and Services and to improve marketing, analytics, and technology functionality, as well as to target our offerings to the users most interested in them based on their past use of the Site and Services.
We offer integration of the Site and Services integration with third party social networking platforms (“Integration”) for the purposes of enhancing the Site and Services. Such Integration is a voluntary feature of the Site and Services, and by using the same you authorize us to collect retain and utilize your data and, as necessary, your Sensitive Data for this purpose. Any such data which is originally collected from you by third party social networking platforms remains subject to the separate privacy policies of each.
Flash LSOs and HTML5
We may use Local Storage Objects (LSOs) such as HTML5 local storage and cookies to store form submitted information. Third parties with whom we partner to provide certain features on our website use LSOs such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML5 LSOs.

Lost or Stolen Information

We cannot be held responsible for any information that has been eavesdropped, hacked, manipulated, or otherwise intercepted while in transit to us. When you send information to us, either directly or through a business partner, please be aware that you are fully responsible for any damage and or loss that is caused.
If we should ever sell its assets, merge with another entity or file for bankruptcy, information collected from the Site and Services may be transferred as assets of SellCast.

All contents of the Site and Services, including text, graphics, logos, and identity devices, button icons, photographic images, audio and video clips, and software, are the property of SellCast and is protected by the intellectual property laws of the United States and by international intellectual property laws (collectively, THE “IP Laws”). The design of all content elements of the Site and Services are the exclusive property of SellCast and as such are protected by the IP Laws.

The Site and Services can be accessed from all fifty states, as well as from other countries around the world. By accessing or using the Site and Services, you agree that the laws of the State of Georgia, United States of America, without regard to conflicts of laws principals thereof, will apply to all matters relating to the Site. You agree and hereby submit to the exclusive personal jurisdiction and venue of the State of Georgia and the state and federal courts located therein with respect to such matters.
If any of these terms shall be deemed invalid, void, or for any reason unenforceable, that term will be ignored but the other terms will remain in effect.
